Terms of Use

1. Parties and acceptance

These terms are an agreement between you and Panda Yazılım (Ostim OSB Mah. 100. Yıl Bul. No:55, Yenimahalle, Ankara, Türkiye; tax office/number: Ostim / 1020650170) ("we", "us") about your use of the Seferim mobile app and related services (the "Service").

By creating an account or using the Service, you confirm that you have read and accept these terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The service

Seferim is a record-keeping app that helps truck owners with 1–5 vehicles keep their trips, expenses, payments and collections, cheques and promissory notes, and reminders in one place. It prepares statements, reports and files for your accountant.

Please note clearly:

• Seferim is a record-keeping tool. It is not tax, accounting or legal advice.
• Seferim is not an e-invoice (e-fatura), e-archive or e-waybill (e-irsaliye) system. It does not issue official documents or report to tax authorities.
• Figures shown in the app, such as profit, VAT and costs, are based on what you enter and are for information only. Ask your accountant about official filings.

3. Account and sign-in

• You must be at least 18 years old to use the Service.
• You sign in with a one-time code sent to your email, Sign in with Apple, or Google sign-in. There are no passwords.
• You are responsible for keeping your email account and Apple/Google account secure. If you notice unauthorised activity in your account, email [email protected] immediately.
• The information you give us must be accurate and up to date.

4. Firms, members and roles

• Whoever creates a firm in the app becomes its Owner.
• The Owner can invite others as Manager, Driver, Accountant or Viewer. Each role can see and change the firm's records to a different extent. Drivers see only the vehicles assigned to them.
• The Owner is responsible for the people they invite and the access they grant. Removing access for someone who no longer works with the firm is the Owner's job.
• Records entered for a firm belong to that firm. If a member deletes their account, the records they entered stay with the firm and only their name is removed. If the Owner deletes their account, the firm and all its records are deleted. Details: Delete your account.

5. Your responsibilities

• You are responsible for the accuracy of what you enter.
• You are responsible for complying with tax, accounting and documentation rules (including invoicing, waybills and bookkeeping and record-retention duties).
• When you enter data about other people, such as your customers, brokers or fuel stations, you must have a lawful basis and follow data protection rules. You are the controller for that data.
• We recommend regularly keeping a copy of important records using the app's PDF statements and CSV export.

6. Acceptable use

When using the Service, you must not:

• use it for unlawful purposes (for example creating fake records or documents, or facilitating tax evasion);
• access someone else's account without permission, or open an account in someone else's name;
• try to bypass the Service's security or access other firms' data;
• overload the Service or access it with automated tools (bots, scrapers) without permission;
• reverse engineer, copy or resell the app (except where the law allows);
• upload malware or content that infringes others' rights;
• use the invitation feature to send unsolicited email.

7. Free trial, subscriptions and payment

• Free trial: you can use Seferim free for 30 days without entering a card.
• When the trial ends: if you don't choose a plan, your records stay and you can still view them; to add new records you need to choose a plan.
• Paid plans are sold and billed through the Apple App Store or Google Play. Apple or Google takes the payment; we never see your card details.
• Auto-renewal: your subscription renews automatically at the end of each period until you cancel, and is charged to your store account.
• Cancelling: you can cancel at any time in your App Store or Google Play subscription settings. Cancellation takes effect at the end of the current period. To avoid the next charge, cancel within the time the store specifies (usually at least 24 hours before the period ends).
• Deleting your account does not cancel your subscription. Your store subscription continues even if you delete your account; you must cancel it separately in the App Store or Google Play.
• Refunds are handled by Apple or Google under their own rules.
• Price changes: we may change prices. Changes are announced in advance in line with the store's rules and apply from the next period.

Any mandatory consumer rights you have under applicable law are not affected.

8. Your data and our rights

• The records, photos and notes you enter belong to you (your firm). You allow us to store, process and display them only to provide the Service.
• The Seferim name, logo, app design and software belong to us. We grant you a non-exclusive, non-transferable right to use the Service for your personal and business needs under these terms.
• If you send us suggestions or feedback, we may use them to improve the Service without any obligation to you.

9. Sharing and verification links

When you share a statement or trip PDF, its QR code or link lets the recipient verify a snapshot of the document as it was when shared. The link shows only that snapshot and expires after 180 days. You are responsible for what you share and with whom.

10. Availability of the service

• The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free.
• The Service may occasionally be interrupted for maintenance, updates or reasons outside our control (such as infrastructure failures or internet outages).
• We may add, change or remove features to improve the Service. If we significantly restrict a paid feature, we will tell you in advance.

11. Suspension and termination

• You can delete your account from the app at any time (Delete your account).
• We may suspend or close your account if you seriously breach these terms, abuse the Service, or if the law requires it. Where possible, we will warn you first and give you reasonable time to export your data.
• If we decide to shut down the Service entirely, we will give you at least 30 days' notice so you can export your data.

12. Limitation of liability

To the fullest extent permitted by law:

• we are not liable for indirect losses such as lost profits, lost data or lost business;
• we are not liable for incorrect or incomplete entries, decisions made based on them, tax filings, or penalties arising from them;
• our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim.

These limits do not apply to damage caused by our intent or gross negligence, or to any liability that cannot be limited by law. Your mandatory consumer rights are not affected.

13. Changes to these terms

We may update these terms from time to time. For important changes, we will notify you in the app or by email a reasonable time before they take effect. If you keep using the Service after the change, you accept the new terms. If you don't agree, you can delete your account and cancel your subscription before the change takes effect.

14. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara have jurisdiction over disputes. If you are a consumer, your right to apply to consumer arbitration committees and consumer courts as provided by law, and any mandatory consumer protections of the country where you live, are not affected.

These terms are also available in Turkish. If the versions differ, the Turkish version prevails.
